Colorado helped launch legal cannabis in the U.S., approving medical use in 2000 (Amendment 20) and adult-use in 2012 (Amendment 64), with retail sales beginning in January 2014. The Marijuana Enforcement Division (MED), within the Colorado Department of Revenue, regulates licensing and compliance; the Department of Revenue also administers cannabis taxes. As one of the oldest markets, Colorado is highly competitive and price-compressed, so operators win on efficiency, compliance, and channels like delivery.

Colorado taxes adult-use and medical cannabis very differently:

  • Adult-use (retail): a 15% special retail marijuana sales tax (which applies in place of the general 2.9% state sales tax), plus a 15% excise tax levied at wholesale (the first transfer from cultivation, based on the state’s Average Market Rate), plus local taxes that vary widely by city (for example, Denver adds a local cannabis tax). Combined effective rates commonly land around 20–30%.
  • Medical: the standard 2.9% state sales tax plus local taxes — no 15% special sales tax and no excise.

  • Adult-use (21+): up to 1 ounce of flower, 8 grams of concentrate, or 800 mg of THC in infused products per transaction.
