This Privacy Policy governs your (“User”) use of the IndicaOnline website (“Site”) and the application for AppleTV, iPad, and iPhone (“Service”) operated by IndicaOnline. We take your privacy seriously and provide this policy to explain the types of information we collect, how we collect it, how we use it, and the circumstances under which we may share it. The Site is not intended for individuals under 18 years of age.

Certain sections of this Privacy Policy apply specifically to users in certain regions. If you are a California resident, please refer to the “California Residents” section for more information.

Information Collection and Use

When you register with us through our website or iPad app (as a “User”), we will collect personally identifiable information (“Personal Data”). This refers to information that can be used to contact or identify you, such as your name, phone number, email address, billing information (if applicable), and your home or business postal addresses. We use this Personal Data primarily to provide and improve our services and to manage your inquiries.

We may also collect non-identifying information, which includes, but is not limited to, data such as your zip code, device version, operating system version, and preferences. This type of information does not directly identify you unless it is combined with Personal Data. For example, combining your zip code with your street address could allow us to identify you, whereas the same information on its own would not.

We may aggregate Personal Data with non-identifying information to improve our services and to better understand how our site and services are used. This aggregation helps us enhance user experience and improve the quality of our service offerings. In some cases, we may use the combined data to deliver more personalized content or services, such as products tailored to your preferences or restrictions.

We may also use your Personal Data to contact you with newsletters, marketing materials, promotional offers, and other information that could be of interest to you. If you no longer wish to receive these communications, you can opt out by following the unsubscribe instructions provided in each message.

Please note, we do not store your financial information, such as billing or credit card details. These are securely processed by third-party service providers.

Additionally, we may use the name and/or logo of the company you work for in marketing materials, advertising, or other promotional materials, unless you specifically request otherwise. Rest assured, all personal information, including your name and contact details, will remain confidential at all times.

Disclosure of Information

Aggregate Information and Non-Identifying Information
We may share aggregated information that does not include personally identifiable information (“Personal Data”). Additionally, we may disclose non-identifying information to third parties for purposes such as industry analysis, demographic profiling, and other related purposes. Any aggregated information shared will not contain your Personal Data and will be anonymized.

Service Providers
We may engage third-party companies and individuals to assist in the operation of our website and services, to provide the services on our behalf, or to perform specific services related to the website (e.g., maintenance, database management, web analytics, and feature improvement). These third-party service providers may have access to your Personal Data only for the purpose of carrying out their tasks on our behalf. They are obligated to keep your Personal Data confidential and are prohibited from using or disclosing it for any other purpose.

Account Information
You are responsible for keeping your IndicaOnline account username and password confidential and agree not to disclose them to any other individual. This obligation continues for as long as your account is active.

 

Location Information

We may collect information about your physical location, such as by using GPS and other geolocation features on your device, or through inference from other data we collect (for example, your IP address may indicate the general geographic region from which you are connecting to the Internet). This information is used to provide our services and enhance your user experience, including dispatching, route optimization, and automatic delivery time updates.

IndicaOnline iPhone App:

  • Collection of Location Data: IndicaOnline may collect and process location data, which is necessary for providing services such as sending location updates to dispatchers and automatically generating delivery time ETAs for customers. Location data is only collected when your shift is active (i.e., your “driver shift” is open).
  • Device Information: We also collect your device’s name and assign it as a default mobile register name within our system. You can change this name in the Register Settings.
  • Data Retention: Location data is stored only for the duration necessary to fulfill the purpose for which it was collected and in accordance with applicable law.
  • Sharing of Data: We do not share location data with third parties except as necessary to provide our services or as required by law.

 

Cookies

Like many websites, we use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record ­keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your registration ID and login password for future logins to the Site. Second, we utilize session ID cookies to enable certain features of the Site, to better understand how you interact with the Site and to monitor aggregate usage by IndicaOnline Users and web traffic routing on the Site. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site and Service and then close your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Service.

We may use cookies for the following reasons and purposes:

  1. To provide the service you have asked for. Some cookies are essential so you can navigate through the website and use its features. Without these cookies, we would not be able to provide the services you’ve requested. For example, some cookies allow us to identify subscribers and ensure they can access the subscription only pages. If a subscriber opts to disable these cookies, the user will not be able to access all of the content that a subscription entitles them to. These cookies don’t gather information about you that could be used for marketing or remembering where you’ve been on the internet. Essential cookies keep you logged in during your visit.
  2. To improve your browsing experience. These cookies allow the website to remember choices you make, such as your language or region and they provide improved features. These cookies will help remembering your preferences and settings, including marketing preferences, remembering if you’ve filled in certain forms, so you’re not asked to do it again, remembering if you’ve been to the Site before and restricting the number of times you’re shown a particular advertisement. We might also use these cookies to highlight Site services that we think will be of interest to you based on your usage of the website.
  3. Analytics. To improve your experience on our Site, we like to keep track of what pages and links are popular and which ones don’t get used so much to help us keep our Site relevant and up to date. It’s also very useful to be able to identify trends of how people navigate (find their way through) our Site and if they get error messages from web pages. This group of cookies, often called “analytics cookies” are used to gather this information. These cookies don’t collect information that identifies you. The information collected is anonymous and is grouped with the information from everyone else’s cookies. We can then see the overall patterns of usage rather than any one person’s activity.
  4. To show advertising that is relevant to your interests. We may sell space on our Site to advertisers. The resulting ads often contain cookies. These cookies are used to deliver adverts more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of the advertising campaign. They are usually placed by advertising networks with our permission. They remember that you have visited a website and this information is shared with other organizations such as advertisers.

Most browsers allow you to turn off cookies. To do this, look at the “help” menu on your browser. Switching off cookies may restrict your use of the Site and/or delay or affect the way in which it operates.

Children’s Privacy

Our Site is not directed to children under the age of 18. We do not knowingly collect any personal information about children under the age of 18. If we obtain actual knowledge that we have collected personal information about a child under the age of 18, that information will be promptly deleted from our database, unless it is necessary to retain it for legal purposes.

If a parent believes that his or her child has submitted personal information to us, he or she can contact us via e-mail. We will promptly delete the information upon learning that it relates to a child under the age of 18. Please note that it is possible some of this information may remain archived in web logs and back-up archives after we delete the information from our active database.

Your California Privacy Rights

We will not share any personal data with third-parties for their direct marketing purposes to the extent prohibited by California law. If our practices change, we will do so in accordance with applicable laws and will notify you in advance. California law requires that operators of online services disclose how they respond to a Do Not Track signal. Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the online service that a user visits, indicating that the user does not wish to be tracked. We do not currently respond to Do Not Track signals.

International Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the information, including personal information, to the United States and process it there, if there is a legal basis for us to do it.

Users’ Rights

This section of our Privacy Policy applies to users of our platform in the EU. We want to inform you of your rights under the EU General Data Protection Regulation (GDPR) and explain how we protect them.

  1. Your GDPR Rights
    You have the right to be informed about how we process your personal information, and to access, rectify, erase, or restrict its processing. Specifically, you have the right to receive information free of charge about the personal data we hold about you, including:
  • What data we have obtained,
  • Where it is stored,
  • How long we retain it,
  • The purposes for which it is used,
  • To whom it has been disclosed.

You also have the right to request that we correct any inaccurate personal data about you without undue delay. This includes the right to request that we complete any incomplete personal data we hold about you.

Additionally, you have the “right to be forgotten,” meaning you can request the deletion of your personal information without undue delay if it is no longer necessary for the purposes for which it was collected. However, we may refuse to erase your data if we can demonstrate compelling legitimate grounds for retaining it.

  1. Right to Restrict Processing
    Under GDPR, you have the right to restrict the processing of your personal data in the following circumstances:
    i. If you contest the accuracy of your personal data, we will restrict processing for a period allowing us to verify its accuracy.
    ii. If the processing is unlawful, and you oppose its erasure and instead request the restriction of its use.
    iii. If we no longer need your personal data for the purposes of processing, but you require us to restrict processing for the establishment, exercise, or defense of legal claims.
    iv. If you have objected to processing under Article 21(1) of the GDPR, pending verification of whether our legitimate grounds override yours.
  2. Right to Data Portability
    Upon request, we will provide you with a copy of your personal data in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another controller, provided it does not adversely affect the rights and freedoms of others.
  3. Right to Object
    You have the right to object, on grounds related to your particular situation, to the processing of your personal information if it is based on legitimate interests (Article 6(1)(e) or (f) of the GDPR). If you object, we will cease processing your data unless we can demonstrate compelling legitimate grounds for continuing.
    If you object to processing for direct marketing purposes, we will stop processing your data for those purposes.
  4. Right to Withdraw Consent
    If you have given consent for the processing of your personal data, you have the right to withdraw that consent at any time.
  5. Rights Related to Automated Decision-Making
    As a responsible business, we do not engage in automated decision-making or profiling that produces legal effects or similarly significant consequences for individuals.

Data Retention

We retain your personal data for as long as your account is active or as long as necessary to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. We will retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. Once it is reasonable to conclude that retaining your personal data no longer serves the purposes for which it was collected, and is no longer necessary for legal or business purposes, we will cease retention or anonymize the data so that it can no longer be associated with you.

The Site contains links to other websites. Your use of these third-party websites is governed by the terms of use and privacy policies of those sites.

Security

IndicaOnline is committed to protecting your information. We use administrative, physical, and electronic measures to safeguard your data from unauthorized access. In the event of a security breach involving your unencrypted personal data (as defined by applicable state laws on security breach notification), we will notify you via email or through a prominent posting on this site as soon as possible, and without unreasonable delay. This notification will be made, unless delayed by law enforcement requirements or the need to assess the scope of the breach and restore data system integrity.

Policy Changes

IndicaOnline reserves the right to modify this Privacy Policy and will post any revisions on the Site. We encourage you to review the Privacy Policy regularly for updates. Your continued use of the Site will be governed by the then-current version of the Privacy Policy.

For minor updates, we will revise the Privacy Policy with a new effective date at the beginning of the document. Our processing of your information will be governed by the updated Privacy Policy from its effective date onward.

For significant changes to the Privacy Policy or if we intend to use your information for a new or different purpose than it was originally collected, we will notify you by email (where possible) or post a notice on our website. We will provide details about the changes, the new purpose, and any other relevant information before using your information for that new purpose.

California Consumer Privacy Act (CCPA) and Other Privacy Rights

This section applies to all residents of California. For purposes of this section, “personal information” is defined in the California Consumer Privacy Act (“CCPA”), but does not include de-identified or aggregated information, publicly available information from government records, or other categories of information excluded from the scope of the CCPA.

As a California resident, you have certain privacy rights under the CCPA, as well as other privacy laws enacted by the state. These rights are summarized below and are subject to limitations and exceptions under the law. In some cases, we may be required or permitted by law to deny your request. If you wish to exercise your rights under these laws, only you, an individual you authorize, or an entity registered with the California Secretary of State that you authorize may make a verifiable request on your behalf.

Your Privacy Rights Under California Privacy Laws:

  1. California Consumer Privacy Act (CCPA)
    • Right to Request Information: You have the right to request a copy of the categories of personal information and specific personal information collected about you over the past 12 months. To make this request, please contact us at support@indicaonline.com.
    • Right to Deletion: You can request the deletion of personal information we have collected from you, with certain exceptions, such as when the information is necessary for legal obligations, security incidents, or fraud prevention.
    • Right to Opt-Out of the Sale of Personal Information: You have the right to request that your personal information not be sold to third parties. IndicaOnline does not sell your personal information, including your name, address, government identification, medical recommendation, or similar personal details. However, certain data (such as cookies and technical data) may fall under California’s definition of “sale” when shared with targeted advertising vendors.
    • Right to Non-Discrimination: You have the right not to be discriminated against for exercising any of your privacy rights under the CCPA.
  2. California Privacy Rights Act (CPRA)
    The CPRA, which amends and expands the CCPA, includes the following rights:

    • Right to Correct Inaccurate Information: You have the right to request that inaccurate personal information be corrected.
    • Expanded Definition of Sensitive Personal Information: The CPRA introduces special protections for sensitive data, such as Social Security numbers, financial information, and health records.

Verifying Your Request:
